Bismillah.
Assalamu alaikum
May this reach you in the best state of health and iman. Ameen.
I have a question regarding stipulations in the marriage contract. I was wondering what the answer is according to both the Hanafi and Maliki schools.
Are stipulations in a marriage contract permissible?
Secondly, is it permissible for a wife to stipulate that she waives her right for financial maintenance until her husband finishes school or attains a higher paying job?
jazakallah khairun. Please keep me in your duas.

salaam,
stipulations are allowed in the marriage contract. However anything that would be against the concept of marriage would be void. So your second question would be void as far as the contract goes.
But on a personal level if your prospect chooses to forego her right then this would be sadaqa on her part but still your responsibility.
But she couldn't be "legally" asked to forego such right as that right is the basis of marriage.

I tried to PM you, but I dont have sufficient privelages to even do that. I think Salafis aren't allowed to PM here. :(
Why aren't you on MSN??? I'd shoot you a PM through Islamica, but it's down.....anyways, if you dont see me online, then please send me a PM with Salman's contact info inshallah....either on Islamica or here...I dont know if I have a PM Box though here because I sure as heck can't find it. I think the moderators closed my PM box. :(
