I'll try to be as clear and brief as possible, although it is a very difficult case.
What does the Sharia in hanafi madhhab say about robbing a family member?
Is there any difference depending on the situation?
Like when a son steals his father/mother and so on?
What should Muslims do?
Is there any divergence between madhahib about this kind of situation?
In fact, the story is the following:
Two years ago, a old slightly senile father who was taken to hospital for some reason, entrusted his property to one of his son. (at that time, one of the few children who still spoke to him and really took care of him)
This son is a long fragile schizophrenic person.
Unfortunately, it seems after some investigation, that the latter took advantage of his old father for steal his money
The son denied everything.
Later, the father again was taken to hospital. And again, he entrusted his property to the same son. ( always because this son was one of the few children who still took care of him ... )
This time, in addition to money, pieces of identification and an overseas house has been stolen by this same son.
The son denied again everything, but some evidence incriminates him.
Months later, the father has been brought to the police. There, he categorically refused to complaint, afterward too, he emphatically repeated that he will not complaint against his son.
He said that he'll manage alone when he will see his son.
But for some unknown reason, the son did not return to the father. The father then said that his son could keep everything, because his son was more important.
Today, the father suffers from neurodegenerative disease. He is no longer able to reason, and has not seen his son before becoming very ill.
He is now under curatorship of another of his son.
The latter wants to complaint against his brother for the father.
What this son should do? Should he respects the last wishes of his father?
