It is not music it is sound that is created by human voice iam sure junaid jamshed asked a scholar before he recorded them if they were permissable or not.

Brother if this is confirm that this is not music, as it looked to me as well, then there is no question of validating it. Because they don't come under 'music'. Isn't it? I couldn't find reason for it's being prohibitted.

Music has been condemned strongly in the Qur`aan and Hadith.

In Surah Luqmaan, Allah Taala states, And from mankind are those that purchase futile speech in order to mislead others from the path of Allah. Under the commentary of this verse, ibn Abbaas [Radhiallaahu anhu] states, 'futile speech' refers to music and things related to it. (Durrul Manthoor vol.5 pg.307).

In Surah Israaeel, Allah Ta?ala states, 'And excite any of whom you can with your voice.' Imaam Mujaahid mentions, 'voice' refers to music. (Roohul Ma`aani) Nabi [Sallallaahu Alayhi Wasallam] mentions, 'There will be people from my Ummah who will seek to make lawful fornication, wearing of silk, wine and the use of musical instruments.' (Bukhaari vol.2 pg.837).

Rasulullah [Sallallaahu Alayhi Wasallam] states, 'A group of my Ummah will drink wine calling it by other than its real name. merry will be made for them through the playing of musical instruments and by the singing of females. Allah will cleave the earth under them and turn them into apes and swines.' (Abu Dawud vol.2 pg.519) Rasulullah [Sallallaahu Alayhi Wasallam] further mentions, 'Music grows hypocrisy in the heart just as water causes crops to grow.' (Bayhaqi vol.10 pg.222). Thus, even conceding that there is benefit in such songs, the fact that music is clearly and expressly condemned in the Qur`aan and Hadith would make such songs Haraam.

As far as singing is concern my understanding is prohibition singing of based on three things:
    - what is being sung? (content)
    - who is singing? (singer)
    - who is listening? (listener)

So if content is bad then it won’t become halal if even it is sung by a man or a child. In the same way I don’t think that for a female it’s allowed to sing in front of a non-mehram, but a female can sung in front of other female or a mehram. These all are my own understandings but Allah knows the Best.

SULTRY or NOT SULTRY is not the issue. If you make it the criteria to make the things halal then it would become very to allow many prohibited things.

    Lightbulb female voice and singing

Just found a QnA on www.darrulifta.com regarding female voice and singing:

    ---

In the name of Allah, Most Compassionate, Most Merciful,

Allah Almighty has created this natural attraction and charm in the voice of a female that it plays a vital role in provoking and inducing the sexual appetite, desire and passion of a man.

This is a reality which can not be denied. Even the psychologists are in agreement with this fact. Many Psychologists have stressed that the voice of an individual plays a great role in arousing sexual desires.

This is the reason why Allah Most High commanded the wives of the blessed Prophet (Allah bless him & give him peace) especially, and all Muslim women in general, to abstain from conversing with non-Mahram men in a soft and sweat tone.

    Allah Most High says:

“O wives of the Prophet! You are not like other women, if you are God-fearing. So do not be soft in speech. Lest in whose heart is disease should be moved with desire.” (Surah al-Ahzab, 32)

This verse indicates that men and women should not talk unnecessarily and when they do so, both the content and manner of conversation must be appropriate, and free of anything inciting.

Imam Abu Abd Allah al-Qurtubi (Allah have mercy on him) writes in his famous exegesis of the Qur’an, al-Jami li Ahkam al-Qur’'an:

“It was a custom of Arab women in the days of ignorance (Jahiliyya) to speak to men in a soft and inciting way. This was prohibited by this verse of the Qur’an.”

It has been narrated from some of the wives of the Messenger of Allah (Allah bless him and give him peace) that, after the revelation of the above mentioned verse, when the need arose for them to converse with a non-Mahram male, they would do so by placing their hands over their mouths. This was to prevent any softness or incitement in their voices. (Hadith recorded by al-Darqutni in his Sunan with an authentic chain of narrators)

The great Hanafi scholar Imam Abu Bakr al-Jassas says in his Ahkam al-Qur’an (his excellent work on the verses of the Qur’an relating to law):

“This verse (above-mentioned) indicates the impermissibility of women raising their voices in the presence of non-Mahram males, as this may lead to Fitna. This is why our (Hanafi) scholars have declared the reciting of Adhan for women as Makruh, as she will need to raise her voice, which is not permissible.” (Ahkam al-Qur’an, 5/229)

    He further says:

“Allah has prohibited women from striking their feet when He says: “And they (women) shall not strike their feet so that there be known what they hide from their adornment.”(24:31). So if they are prohibited from letting non-Mahram hear the sound of their footwear, then the prohibition of raising the voice in an inciting way will be prohibited from a greater extent.” (ibid)

Allama Murtadha al-Zabidi, the great Hanafi faqih, Sufi and linguistic says in his commentary of the 'Ihya' of Imam al-Ghazali, 'Ithaf al-Sadat al-Muttaqin':

“A group of Scholars have distinguished between the singing of males and females. Listening to the singing of non-Mahram women has been declared by them as Haram, and the listening to the singing of Mahram women is deferred upon. Qadi Abu Tayyib al-Tabari said: If the singer is a non-Mahram female, then it will not be permissible for men to listen to her. This ruling will apply, regardless of whether the woman is with or without Hijab.” (Vol: 6, P: 501)

The above-mentioned is clear in determining that, one should avoid listening to the voice of a female unnecessarily. If there is a need to converse with them then, it should be done in the manner stated previously.

Is the voice of a female part of her Awra?

As far as the female voice is concerned, according to the preferred opinion in the Hanafi School, it is not considered to be part of her nakedness (awra). However, if there is a fear of Fitna then, the female should not raise it and the male should avoid listening to it.

One of the great Hanafi scholars Ibn Humam (Allah have mercy on him) says in his 'Fath al-Qadir', quoting from 'al-Nawazil':

“The melodious voice of a female and her singing will be considered as Awra. This is the reason why it is better for her to learn the Qur’an from a female teacher rather than a male who is blind, as her recitation in tune is Awra. The Prophet (Allah bless him and give him peace) said: “The reciting of Tasbih is for men and clapping is for women.” (m, Meaning if the Imam makes a mistake in Salat , the males will invite his attention by reciting Subhan Allah and women, by clapping their hands). (Fath al-Qadir, 1/260)

Imam Ibn Abidin, after quoting the same from al-Nawazil writes in Radd al-Muhtar:

“It is permissible for women to converse with non-Mahram men at the time of need (and visa versa, m). However, what is not permissible is that they stretch, soften and raise their voice in a melodious way.” (Radd al-Muhtar, 1/406)

From the contemporary scholars, Dr. Wahaba al-Zuhayli from Damascus writes in his famous al-Fiqh al-Islami wa Adillatuhu:

“It is unlawful (haram) to listen to the voice of a female, which is in a melodious and musical tone, even if it is by reciting Qur’an.” (1/755)

The above quotations indicate that a woman’s voice is not part of her Awra. However, it will not be permissible for her to raise her voice in a melodious way, and men will not be allowed to listen to the singing female voice. When a woman sings or raises her voice in a melodious way, it then becomes part of her Awra.

Thus, in conclusion, it is evident that a male should avoid listening to the Nasheed and Na’at of non-Mahram females. Similarly it is necessary that females do not sing in front of non-Mahram men, whether in their presence or by recording their voices and releasing albums.

So based on this, was musical instruments really forbidden due to music or was it due to the use of those specific instruments mentioned in that time?

Another issue I came across is this, please don't beat me up too bad cause here comes something controversial... Children singing is allowed but many say that women singing is not allowed. Now I have a few points about this:

    1) Women usually sing in Soprano (very high), Alto (a bit lower), and Contralto (very low). Men usually sing in Basso-Profundo (lowest), Bass (Base), Baritone, and Tenor (if they are high). Guess what kids usually sing in? Soprano!! They sing in a woman's voice!! So what is the difference between them singing and a woman singing? Many times I have heard Quran recited or Nasheed and I have to ask - is this a kid or a woman? Now the obvious difference is the issue of being sultry (like Jessica Rabbit from "Who Framed Roger Rabbit?"). However, a woman singer IS NOT inherently sultry. Examples: Female Rappers, Opera Singers - neither of these are normally sultry (sexually stimulating). So why would these not be allowed? You could also add (I imagine) women who sing in contralto to that list and even others - as long as it is not sultry. If it isnt sultry it is the same as a child's voice in many cases or even LOWER in pitch (this issue is an issue of pitch while decibels is about volume).

    2) Ok here is more toward this argument:

Al-Tirmidhi Number 941, Narrated Abdullah ibn Abbas - Aisha gave a woman relative of hers among the Ansar in marriage and Allah's Messenger (peace be upon him) came and said, "Have you escorted the girl to her husband?" On being told that they had, he asked whether they had sent someone along with her to sing, and when she replied that they had not, he said, "The Ansar are a people who give a place to love songs. I wish you had sent with her someone to say, 'We have come to you, We have come to you; so may Allah preserve us and preserve you'."

    Ibn Majah transmitted it.

    - Now this practice of sending singers with the bride to the groom is still practiced today from what I am told. A Syrian sister described their ritual to me. Six women or so, usually adult relatives of the bride, her aunts, etc., escort the bride while singing to the groom in a gesture of "giving her away". I am thinking, was this ritual the same back then? It very well could have been, and there is evidence of using female singers to do this in the hadith literature, such as the hadith:

Al-Tirmidhi Number 940, Narrated Aisha - I had a girl of the Ansar whom I gave in marriage, and Allah's Messenger (peace be upon him) said, "Why do you not sing, Aisha, for this clan of the Ansar like singing?"

Ibn Hibban transmitted it in his Sahih.

In this case it was Aisha herself!! Now one could argue in her case that she was a child, but then again they are obviously in Medina (Ansar) and likely already married. So she might have already been pubescent, unless she was married before puberty, which might be true. In anycase, the modern day tradition is done by mature women and there is not doubt about their maturity. Was it the same in the time of the Prophet (saaw)? Remember it was girls on the Eid singing and children (and I'm sure it wasnt all boys) who sung upon his arrival in Medina. There were songstresses who were condemned in the hadith literature (due to their alluring, dancing lewdly and sultry singing). So my point is that the atmosphere was full of female singing and it is likely that it was women as it is today that accompanied the bride while singing.

That was some food for thought I guess, but if anyone would like to chime in (without bias please!!!) then please do so. As far as I am concerned at this point, I have no problem with Malaysian women reciting Quran on tape (Soundvision was selling a tape some time back of that), or pubescent girls reciting in Quran competitions (which I have seen many times), or women reading poetry as a poet (emphatically), or opera, or women rappers (positive rap - hey its part of our western culture), or women singers in general as long as they are NOT SULTRY. That means Jessica Simpson, Shakira, Brittany Spears, and the like are out of the picture. Roseanne Barr once sung the national anthem (badly but sung it lol) and it wasnt exactly sultry lol. When I was in Morocco I saw a great singing group who had a woman singer with a very tough Arabic voice and it wasnt sultry at all.
