    Default Child Marriage

    Asalam O Alikum,
    Police raid on a house about 2 evening ago in Karachi... There was a marriage is going to be in between 8 years old boy & 4 years old girl...

    The father said that they had few family crisis so they wanted to fix their problem in this manner... However the Imam who was going for Nikkah said this is Ok... Then he said after watching the kids they were going to engage then in written form.... Wallah ho Alam

    Asalam O Alikum
    Alhamdulillah Muslim by birth but wants to explanation of every thing for me as well as others.. Hope you got the point... Jazak Allah Karim

    Mufti Muneebur Rahman came on TV stating the marriage was perfectly fine and legal under the Shariah.
    And if he were to ask for a gentle lady in marriage, he would be refused, and when he leaves the world it does not miss him, and if he goes out, his going out is not noticed, and if he falls sick, he is not attended to, and if he dies, he is not accompanied to his grave.

    I've always thought that both the groom and bride must be over puberty for marriage. How can it be valid? Did anyone get married at this age during the prophet's time?

    According to all schools of law it is perfectly valid to give one's daughter or son in marriage, even if he/she has not reached puberty.
    And if he were to ask for a gentle lady in marriage, he would be refused, and when he leaves the world it does not miss him, and if he goes out, his going out is not noticed, and if he falls sick, he is not attended to, and if he dies, he is not accompanied to his grave.

    I have just been confirmed that according to the maliki madhhab that this marriage would be perfectly valid but the difference being that the groom's consent must be given. So the groom can't just be given in marriage first without approval.

    Are you talking here about the approval of the wali, or the child himself?

    Both of their consent must be given. Groom and Wali. So yes the boy (child) and the guardian of the girl.
