    Default Help: Imam Malik on Mut`a

    assalamu `alaykum wa rahmtullah
    Someone is trying to claim that Imam Malik endorsed mut`a. Could someone find a quote from Imam Malik regarding his real position on the issue? I can find things in whichever post-classical texts are available online, but I do not know how to search for an actual quote from Imam Malik himself. Barakallahu bikum.

    The attribution is totally incorrect, originating from the author of Hidayah in Hanafi fiqh.
    Nearly all the commentators of Hidayah have pointed out the incorrect attribution.
    Sahabah رضي الله عنهم would cling fast to the Sunnah, on account of it being Sunnah, while we discard the Sunnah, on account of it being (just) Sunnah!

    Of course Imam Malik rejected mut`ah. What I am trying to find is a quotation from him in which he rejects it that one could use as a reference.

    You will find the relevant information in the imam's own work al-Mudawwana al-kubrā, in the section entitled النكاح إلى أجل . In the Beirut edition of the work published by Dār al-Kutub al-ʿIlmiyya in 1415/1994, the section is found in vol. 2, p. 130.

    Would just like to point out that al-Mudawwana al-Kubra was not Imam Malik's own work, but the work of Imam Sahnun ibn Sa'id (who was a student of one of the Imam's main students, 'Abdur-Rahman ibn al-Qasim). - Rahimahumullah ajma'in.

    Actually Imam Sahnun was not a direct student of Imam Malik. Imam Sahnun got the bulk if not most of the positions of Imam Malik from Imam Malik's student Imam ibn al Qasim. The book is formatted in an type of Question and Answer format. The work was started by Asad ibn al Furat but was later revised and refined by Imam Sahnun.
    Imam ash-Shafi`i said, "Whoever takes knowledge from books loses the regulations." (man akhadha al-`ilma min al-kutubi Dayya`a al-aHkaama). [Reported by Nawawi in the introduction to "al-Majmu`"]
