    Default Zakaat question.

    As salaam alaikum wa rahmatullah,

    If a women has gold jewellery which weighs 35 grams and is worth £682.50, is she obliged to pay Zakaat on it?

    Zakaat Nissab for gold is 87.48 grams and for Silver is 612.36 grams.

    Which Nisaaab do we take? Because one is worth more than the other. In the case of Gold do I strictly use the Gold Nisaab as a measure? Please let me know, may Allah reward you.

    W-Salam,

    Ulama of Deoband tend to give a Fatwa to take the lesser Nisaab into consideration i.e. based on Silver.

    I had extensive discussions with Shaykh (Dr) Awadullah during a course and he stated that Hanafi Ulama of Egypt respect the Ulama of Deoband but disagree and state that Gold is actually the valued currency of the day therefore the higher Nisaab (based on Gold) should be considered.

    I then took the answer from Shaykh (Dr) Awadullah to a visiting Mufti from Darul-uloom Deoband and he disagreed and still preferred Nisaab based on Silver and gave the reasons given in the following Fatwa and preferred the Nisaab based on lesser value (i.e. that of Silver).

    Personally Zakah is such an important pillar of Islam that I would personally error on the side of caution pay it on the basis of Silver.

    I am not an Alim or a Mufti so can't give you an answer, these are just my views and some research on the matter.

    Walikum-us-salam wr wb.

    There is a huge amount of misunderstanding within the ummah on the issue of Nisaab.

    Remember this clearly, Nisaab for Gold is 7.5 Tola, ONLY if the person has NO silver, NO cash and NO maal-e-tijarat.

    If the person has SOME gold, and he has 100 pounds/dollars with him, then the Nisaab for that particular person would be different. Zakat would be fardh on that person, even if the gold he has is less than the Nisaab.

    In your case, does the lady have ANY cash, or ANY silver? Even if the lady has 10 pounds with her, Zakat is fardh on her.

    The masail of zakat are very important, and they can't be learned just by reading a book or a fatwa. You actually have to spend some time with a good aalim.

    Therefore as you can clearly see that if someone takes GOLD as the standard the Nisaab comes out to over $3000 (US Dollars) VERSUS if someone takes Silver to be the standard the Nisaab comes out to be around $355 (US Dollars) and hence the discrepancy as to which number (or rather the standard i.e. Gold or Silver) should be taken into consideration.

    Warning: This is just a mock calculation exercise using the latest Gold & Silver prices in the trading market to illustrate a point. Please don’t rely on it for your Zakaat and do your own calculations.

    Ok, let's say the lady only has Gold and no money or silver upon which to pay Zakaat, will she still take the Nisaab of Silver to work out whether or not she should pay Zakaat on her Gold? Because if she takes the Gold Nisaab, her amount of Gold is below the Gold Nisaab.
