    Default Is it permissible for muslims to eat kosher meat?

    I have seen conflicting views on this topic. I just want to know if it is permissible for Muslims to eat kosher meat.

    So the assumption is that during the time of the Prophet Muhammad alayi salatu wa salaam, the jews and christians killed by saying the name of Allah first? Even though they were at that time worshipping Jesus, commiting shirk, and belying the messengers? If you say that the christians and jews at that time were upon the real religion of their messengers, then this would essentially eliminate the need for Allah to send down the Qur'an(in theory not in reality), Because these people would still be following their respective religion according to how Allah had willed, and how their messenger had taught them. However this is incorrect, because there were amongst them, who took jesus as God, and who took him as the son, and this can be found in the story of the first hijra, like wise Allah says so himself in numerous ayat, and proof enough against the theory that they were upon the truth(meaning worshipping allah correctly, ie: udhihiya.) is the verses in surah Alfatihah.

    For the most part kosher is not halal according to the Sunnipath. However, I have seen for example tea bags that have both halal and kosher labels. Also, when I buy potatoe chips I rely on the ones that say kosher because most cheese products (i.e.Doritos) can not be traced, is not halal nor does it have a kosher symbol.

    I agree with you completely about the Ahlul Kitab having corrupted beliefs in the past as well, but as for slaughter in the name of Allah:

    A lot of people tend to misuse Allamah ibn Uthaymin's fatwa to justify eating haram food (I am not saying you are necessarily one of them); shaykh clearly makes slaughtering in the name of Allah and cutting properly conditions for the slaughter to be halal, regardless of who is slaughtering. However, he does state that we do not need to inquire if the name of Allah had been pronounced at the time of slaughter, and the meat is only haram for us to consume if we know for certain that tasmiyyah was not done at the time of slaughter.

    Since, we know for certain that the meat in butcher shops and restaurants in the states is not slaughtered in the name of Allah (with the exception of zabihah and kosher venues), it is clearly haram according to the conditions that he has listed.

    فإن قيل : ما الجواب عما ثبت في صحيح البخاري وغيره من حديث عائشة رضي الله عنها : أن قوما قالوا للنبي صلى الله عليه وسلم : إن قوما يأتوننا بلحم لا ندري أذكروا اسم الله عليه أم لا ؟ فقال : (( سموا عليه أنتم وكلوه )) قالت : وكانوا حديثي عهد بالكفر(98) .

    قلنا : الجواب : أننا نقول بمقتضى هذا الحديث ، وأنه لو أتانا من تحل ذكاته من مسلم أو كتابي بلحم حل لنا أكله وإن كنا لا ندري هل ذكر اسم الله عليه أو لا ، لأن الأصل في التصرفات الواقعة من أهلها الصحة حتى يقوم دليل الفساد ، ولسنا مخاطبين بفعل غيرنا ، وإنما نخاطب بفعلنا نحن ، وقد أشار النبي صلى الله عليه وسلم إلى ذلك حيث قال : (( سموا عليه أنتم وكلوه )) كأنه يقول : أنتم مخاطبون بالتسمية عند فعلكم وهو الأكل ، فسموا عليه ، وأما الذبح والتسمية عليه فمخاطب به غيركم ، فعليكم ما حملتم وعليهم ما حملوا ، وليس يعني أن تسميتكم هذه تغني عن التسمية على الذبح ، وذلك لأن الذبح قد فات .

    وليس في الحديث دليل على سقوط التسمية بالجهل ، ولا على أنها ليست بشرط لحل الذبيحة ؛ لأنه ليس فيه أنهم تركوا التسمية فأحل لهم النبي صلى الله عليه وسلم اللحم ، وإنما فيه أنهم لا يدرون أذكروا اسم الله عليه أم لا ، والأصل أن الفعل وقع على الصحة ، بل قد يقال : إن في الحديث دليلا على أن التسمية شرط لحل الذبيحة ، وأنه لابد منها ، وإلا لما أشكل حكم هذا اللحم على الصحابة حتى سألوا النبي صلى الله عليه وسلم عنه ، ثم لو كانت التسمية غير شرط أو كانت تسقط في مثل هذه الحال لقال لهم النبي صلى الله عليه وسلم : وما يضركم إذا تركوها أو نحو هذا الكلام ؛ لأنه أبين وابلغ في إظهار الحكم وسقوط التسمية ، ولم يرشدهم إلى ما ينبغي أن يعتنوا به وهو التسمية على فعلهم .

    لما كان الكلام في بعض شروط الذكاة مطولاً ؛ أحببنا أن نذكر في هذا الفصل خلاصة تلك الشروط ؛ ليكون أيسر في حصرها ، فنقول : خلاصة ما سبق من الشروط التسعة كما يلي:

    الأول : أن يكون المذكي ممن يمكن منه قصد التذكية ، وهو المميز العاقل .

    الثاني : أن يكون مسلما أو كتابيا .

    الثالث : أن يقصد التذكية .

    الرابع : أن لا يذبح لغير الله .

    الخامس : أن لا يهل لغير الله به ، بأن يذكر عليه اسم غير الله .

    السادس : أن يسمي الله عليها .

    السابع : أن تكون الذكاة بمحدد ينهر الدم غير سن وظفر .

    الثامن : إنهار الدم في موضعه .

    التاسع : أن يكون المذكى مأذوناً في ذكاته شرعا . "
