    Default Hidayah on forbidance of Musaharah

    salam aleykum

    Hidayah, Kitab Nikah, Fasl fi Bayan Al Muharimat

    “ The one who is touched by a woman with desire, her mother and daughters are forbidden fo him ( for Nikah) and Shafii said it does not forbid, and on this is khilaf of his touching a woman with desire of his looking at her Faraj or her looking to his zakar with desire, because touching and looking is not in the meaning of entering ( intercourse) so there is no link with Fasad of fasting and Ihram and obligation of Ghusl, so these two things ( looking and touching) are not added to that, and for us ( Ahnaaf) touching and looking is a sabab ( cause) calling to intercourse, so it takes its place ( Yuqamu Maqamahu) because of security ( Ihtiyat), then touching with desire is that the penis becomes big and strengthens, and this is saheeh ( meaning there is ikhtilaf oif Ahnaaf for this), and what is mu’tabir ( there is also ikhtilaf in that) for looking at entering of faraj and it does not become true except when she lies down, and if he touches and then ejaculates then it has been said it leads to forbiddance, and the saheeh ( another ikhtilaf) is that it does not lead to, because of his ejaculation he made it clear that hw eas not desiring intercourse, and on the same is coming to a woman from her dubur”

    1) So one can see that the author of Hidayah added all these forbidden woman to the Quran with no Mashoor ahadeeth but with his ray and Qias.

    2) There are three cases of ikhtilaf, one can wonder if they have daleel for that, or it is pure Ray. So we can see how many conditions are put to add to Quran.

    3) One doing something worse than merely looking like touching and ejaculating and coming from her back, then it does not forbid. Very strange Ray.


    I will ask moderators not to censor this post, it would mean you are against your own fiqh, you have shame to put it on internet, or you do not want to show its contradiction. Hidayah’s guidance is told by Ahnaaf to be like guidance of Quran.

    And you should not fear to put truth according to you, how do you want Ahnaaf to know their fiqh if you censor these kinds of Masail

    If you can - please quote the views from the other Madhhabs, like the Maliki and Hanbali. It appears all you are set out for here is malignment of the Hanafi Madhhab. You should also look at the strange Fatawa that "Ahl-e-Hadith" in the Indian subcontinent have come off with over 100+ years. Hint: Read the works of Shaykh Abu Bakr al-Ghazipuri in arabic and urdu if you want some clues. May be i will scan up the covers just for you and your brethren here.

    As sallamu alaikum

    So you mean that if a guy touches his aunty with desire he can't marry her daughters and ancestors? but you can't marry your aunty anyway. That fatwa although seems simple has for some reason got me in to a twist. Please explain with examples.
