    Great article. We covered some of this in the beginning of fiqh class in Shariah Program but not in as much detail.

    One interesting thing to note, that is not explicitly mentioned, is that the Ḍāhir al-Riwāyah date from before even the birth of Imam Bukhari . So be aware that our fiqh is actually transmitted at a high level of authenticity from an even earlier generation than Sahih Bukhari was written. In the commentaries of the following centuries, you find discussion of ahaadeeth from Sahih Bukhari, etc. and how they are related to a particular ruling. I don't know if this means anything from an academic standpoint but it was an interesting fact to me anyway, and lends some authenticity that the madhab-deniers cannot hope to match.

    Recently, I had a discussion with a ghayr muqallid brother about whether the fard salaah becomes invalid if a fifth rakaa'ah is prayed by mistake. I read him the ruling from Bahishti Zewar, he mentioned the hadith in Sahih Bukhari which appears to contradict the ruling, and he asked in kind of a disappointed way, "Do they give any, you know, daleel, or anything?" I told him in the books of fiqh there would be dalaa'il but that is a book for laymen, so you wouldn't find daleel in it. Anyway he's a sincere brother, he didn't argue or anything, just said ok, and went away. However, I got the feeling he must be thinking in his head, "I knew it, that's what the Shaikh was talking about, these Hanafis, they just follow Imam Abu Hanifa, not the hadith."

    I was interested, so I went home and looked up in Al-Mabsut of Imam Sarakhsī. What do you know, in the section on Sajdah-e-Sahw, that exact hadith is mentioned, and a full section devoted to it's meaning and proving that its meaning is not what is first apparent. And I mean, after reading it, it is very clear that the meaning is not what you'd first think; the actual meaning is not something the mind goes toward automatically, but when informed of it, it is extremely satisfying. After some debate with myself, I decided to photocopy those pages and give it to that brother. Hopefully, it will change whatever impression he had to be more positive and he might change his ideas.


    I'm not actually sure about the appropriateness of what I did, giving those books to someone who hasn't studied properly etc. might be opening another can of worms. But the brother was sincerely worried, I feel, and I just gave that single discussion, so it may be a source of guidance that whatever we're doing is not arbitrary, as they are led to believe, nor based on ignorance of the ahaadeeth.

    you sent me a link to it but i think ive deleted it by mistake. I think it was course on hanafi fiqh or something and I think it was due to start sometime in september.
