    Default wealth & blood of non-muslims?

    as salamu alaykum

    maybe this has been addressed in the forum already - if so, can someone provide the link but if not have the read of the following article.

    i don't know who it is by... but it quotes many classical scholars.

    basically, it states that the blood and wealth of non-muslims is permissible because they are kafir, not because they are civilians or combatants. anyone's opinions on this would be beneficial.

    For a different take on the classical understanding of Jihad and a discussion of the Verse of the Sword, etc....

    Imam al-Zarqani said in his book Manahil al-Irfan: 'Our Scholars agreed that if a word carries 99 aspects of disbelief and one aspect of faith, it must be interpreted according to the best of meanings, which is faith'.

    Yeah I read that.

    I was confused though between that and what I recently read in al-Aqeedah al-Tahawiyyah which said:

    "Hajj and Jihad are continuing obligations on Muslims" or something to that effect.

    ...Imam Zaid's article does not really delve into the classifications of dar al islam and dar al harb. (don't get me wrong - its excellent...)

    also, the specific issue of whether the blood and wealth of a kafir is permissible to take based on their kufr, and not whether they are civilian or combatant..

    I haven't had the time to read the tibyan article but what are the primary textual evidences they bring? Perhaps we can then find out what the Ulema say about each ayah / hadith?

    I like Imam Zaid's article.

    I have read that Jihad is only wajib in two cases in the Maliki school:

    a) The Khalifah drafts you into the Muslim army,
    b) An enemy attacks the Muslims with weapons of war.

    ...and the ahadith:

    The Prophet (S.A.W) has stated, "Jihad will continue till the day of judgement."

    ...of course - jihad has many meanings as we know... Allah knows best

    He also stated in another statement, " A group of my ummah will always continue to fight in the name of Allah."

    ...dunno the source and authenticity of this hadith.

    lets start with the hadith (also in Imam Nawawi's forty):

    'I have been commanded to fight people until they say la ilaha ila Allah'

    and:

    "I have been ordered to fight the people till they say: 'None has the right to be worshipped but Allah.' And if they say so, pray like our prayers, face our Qibla and slaughter as we slaughter, then their blood and property will be sacred to us and we will not interfere with them except legally and their reckoning will be with Allah." Narrated Maimun ibn Siyah that he asked Anas bin Malik, "O Abu Hamza! What makes the life and property of a person sacred?" He replied, "Whoever says, 'None has the right to be worshipped but Allah', faces our Qibla during the prayers, prays like us and eats our slaughtered animal, then he is a Muslim, and has got the same rights and obligations as other Muslims have."

    and another one narrated by Muslim along the lines:

    'whoever says the shahadah, then his wealth and blood are unlawful..."
