This is the perfect example to show the differences between the Madhabs.

Maliki Fiqh

In Maliki fiqh the following break the fast of Ramadan and require Kaffarah:

  • Masturbation
  • Ejaculation
  • Intake of food or drink
  • Sexual Intercourse


In Maliki fiqh for every seperate fast you break you must do one Kaffarah.

But in Maliki fiqh it is more reccomended to feed 60 poor than to fast 2 months. Al-Risalah of al-Qayrawani states:



The kaffara for breaking the fast consists of feeding sixty poor people with one mudd for each person using the mudd of the Prophet, may Allah bless him and grant him peace. This is the preferred way of doing kaffara according to us...

There disagreement about which of the three types is best. The well-known position is that it is feeding and that is what is stated here. It is preferred by some of the people of Malik because it has more benefit.


Hanafi Fiqh

In Hanafi fiqh the fast necesitates kaffarah if it is broken in the following ways:

  • Intake of food or drink
  • Sexual intercourse


In the Hanafi fiqh multiple kaffarahs can be offered under the same kaffarah. For example one can do kaffarah on 30 fasts through only one kaffarah.

But yet in Hanafi fiqh the kaffarah says those who are able to fast 2 months cannot simply feed as kaffarah.

Shafii Fiqh

In Shafii fiqh the following requires kaffarah:
  • Sexual intercourse


In Shafii fiqh one has to do a kaffarah for each individual day that necessitates it. The Shafii kaffarah also says those who are able to fast 2 months cannot simply feed as kaffarah.
