Role of Context in Divorce
Aoa brothers and sisters,
I am not a scholar of islamic jurisprudence but a question arised in my mind when i got a ruling regarding a matter of divorce. http://www.sunniforum.com/forum/show...t-mean-divorce Problem in post #8 and corresponding ruling in post #13 by esteemed brother.
Alhmdllillah I am pleased with this ruling but curious as to how the matter is treated.
Now suppose that a husband and wife sit and discuss the topic on talaaq and at the end of discussion the husband says that "I am/was talking about divorcing you".
What I want to know is how do we decide what part of their discussion he means when he says this. Could we take his statement and apply on for example lets say a conversation that took place another day or a week before? because he does not say for example " I am/was talking about divorcing you when I said you should leave me" in other words he does not specify the part of the conversation he means.
this has got me little confused and a little worried that could this statement of the husband have effect on earlier conversations too? I hope you can clear this up. jazakAllah in advance.
