    Default Zakat



    If one has invested money in land, should one pay zakat for that plot?

    If the intention is to sell out the land in future then one should pay zakat for the plot every year till the land is sold off according to the value plot that exists at that time.

    If you don't have the intention to sell then you don't to pay zakat for the land. After some time if you make intention to sell out the land, from that time you have to pay zakat for that land.

    This is what I learnt.

    It is reported from Abu Umamah from the Prophet (Sallallahu 'Alayhi WaSallam) that he said:

    اتَّقُوا فِرَاسَةَ الْمُؤْمِنِ ، فَإِنَّهُ يَنْظُرُ بِنُورِ اللَّهِ

    " Fear the Insight of the Believer, for verily he sees with the Light of God"

    I was told a similar ruling by a senior mufti and I even posted it but then edited my post as this section is for scholars to answer. its kind of against the rules I think

    What if one has sort of intention like in future one can use the land for personal use or it can be sold depending on the situation.

    Answer:

    In principle there is no Zakaat on land if there was no intention of trading it at the time of purchase.


    الدر المختار ( ص 267 / ج 2 / دار الفكر )
    (وَشَرْطُهُ) أَيْ شَرْطُ افْتِرَاضِ أَدَائِهَا (حَوَلَانُ الْحَوْلِ) وَهُوَ فِي مِلْكِهِ (وَثَمَنِيَّةُ الْمَالِ كَالدَّرَاهِمِ وَالدَّنَانِيرِ) لِتَعَيُّنِهِمَا لِلتِّجَارَةِ بِأَصْلِ الْخِلْقَةِ فَتَلْزَمُ الزَّكَاةُ كَيْفَمَا أَمْسَكَهُمَا وَلَوْ لِلنَّفَقَةِ (أَوْ السَّوْمُ) بِقَيْدِهَا الْآتِي (أَوْ نِيَّةُ التِّجَارَةِ) فِي الْعُرُوضِ، إمَّا صَرِيحًا وَلَا بُدَّ مِنْ مُقَارَنَتِهَا لِعَقْدِ التِّجَارَةِ كَمَا سَيَجِيءُ، أَوْ دَلَالَةً بِأَنْ يَشْتَرِيَ عَيْنًا بِعَرَضِ التِّجَارَةِ أَوْ يُؤَاجِرُ دَارِهِ الَّتِي لِلتِّجَارَةِ بِعَرَضٍ فَتَصِيرُ لِلتِّجَارَةِ بِلَا نِيَّةٍ صَرِيحًا .

    (وَمَا اشْتَرَاهُ لَهَا) أَيْ لِلتِّجَارَةِ (كَانَ لَهَا) لِمُقَارَنَةِ النِّيَّةِ لِعَقْدِ التِّجَارَةِ (لَا مَا وَرِثَهُ وَنَوَاهُ لَهَا) لِعَدَمِ الْعَقْدِ إلَّا إذَا تَصَرَّفَ فِيهِ أَيْ نَاوِيًا فَتَجِبُ الزَّكَاةُ لِاقْتِرَانِ النِّيَّةِ بِالْعَمَلِ (إلَّا الذَّهَبَ وَالْفِضَّةَ) وَالسَّائِمَةَ، لِمَا فِي الْخَانِيَّةِ: لَوْ وَرِثَ سَائِمَةً لَزِمَهُ زَكَاتُهَا بَعْدَ حَوْلٍ نَوَاهُ أَوْ لَا .

    Question:

    Did I understand right that then zakat should be paid only after the land is sold? Yaani after the money comes in hand and a year passes like how zakat is paid on normal cash above nisab?

    Answer:

    If one recieves money, then whatever the intention (trade or otherwise), Zakaat will have to be paid for that money. This amount will be added to all your Zakaatable assets, thereafter on the due date if you have Nisab you will pay Zakaat also accounting for the cash received from the land in your calculation.

    I am really sorry but I need further clarification.

    I dont know what exactly is trading mean here but I stated the intention which is sort of mixed. Now should one pay the zakat for the land every year looking at the market rate of the land or if it enough to pay the zakat on money that was got after selling the land.

    Sorry for my bad English but I hope you got my question. Please do kindly clarify.
