    Default smuggling, taxation and obeying local laws



    I had always heard that bringing stuff from foreign countries to sell in local countries, while not paying custom duty was haram.
    A lot of ladies bring clothes from India/Pak to sell in US, they then advertise on local desi mailing lists and sell from homes. Upon arrival there is a custom declaration form, asking if anything is being brought in for commercial purposes.

    There is a strong likelihood that customs duty was avoided by declaring clothes for personal use at time of arrival in the US. Lets form this as an assumption for the questions below

    1. It is haram to give dharr (hurt) to another muslim/person. When people smuggled clothing to Pakistan from Thailand, it destroyed local garment industry. I would guess this would be haram due to the dharr caused ?
    2. In the US there is no Desi garment industry. so I am guessing the above clause doensnt apply. Correct ?
    3. On one hand there is obeying of local laws in shariah. on the other hand there are ahadith (the woman who repented by getting rajm) where Rasul severly condemns the taxman. A taxman I have heard was considered like a highway man. In my limited knowledge, contemporary Ulema allow taxation for public services. However what is the ruling on customs duty, that of unnecessary taxation or obeying local laws ?
    4. Is it halal to bring clothes from Indo-pak, declare them for personal use ( hence avoiding customs duty) and then sell them(without using them) at exhibitions in houses/homes/desi stores etc

    Mufti AH can you please take a look on the issue of paying customs duty for commercial/personal use items.
    The rest of the question I believe is around this issue.
