    One of the prohibitions is not smoking so does that mean it's not haraam when you are not fasting?

    According to Salafi Scholars, smoking is haram whether fasting or not fasting.

    what do you mean salafi scholars. many scholars from all madhahib.

    when smoking first came to muslim lands it was seen as makrooh because the harms were not know but the smell was offensive so the ulama in some places qiyaas with eating raw onions & garlic. so if a persons breath was smelling he should not attend jamaat in the masjid. when the harms were well known then many ulama gave fatwa making it haraam.

    one alim said to us in a majlis" if onions & garlic are halaal but not desirable to eat before salah can you imagine smoking before the salah when there is so much ikhtilaaf around it"

    Exactly

    Habib 'Umar's had alluded to its prohibition. So has Habib Husayn as-Saqqaf of Dubai.

    Some of the awliya' of the past who were known for kashf like Sayyid Ahmad b. Idris and ad-Dabbagh were adamant that it was Haram right from day 1!

    There are prohibited acts which exist in today's society ;
    1. muslim drinkers
    2. Not offering Salah
    3. men women mix in schools, colleges
    4. A person not having Islamic knowledge wants to stand in the mimbar and hold the mic and talk rubbish.
    5. Women dont know the basics of Islam, eventhough they wear Niqab

    Lets identify this problem first and then try to ask our brothers/sisters to stop smoking.

    by that same token, i could say, there are many Muslim drinkers so let us forget about salah until we eradicate the problem of alchohol. . . clearly that's called flawed reasoning, in much the same way as telling us to ignore the smoking issue.

    if we should worry about these first & not worry about smoking that much then why do so many people worry about the length of the trousers & the beard. we quick to label people when the problem is not with us but when we have the problem ourselves then we we quick to say that we should first worry about salah & this & that.

    I was told about a sheikh in Tarim that knew a smoker & the smoker tried to hide his pack away & the sheikh found it every time. then one day the man put his pack under a rug & then his bed over the rug & the sheikh pin pointed the exact spot where the cigaretes were.
