    Default responsibilities of a business when hiring workers



    what is the shariah responsibility of a small business owner when hiring workers. Local laws here in the US ask that only those authorized to work should be given jobs.
    Its an open secret that many undocumented or falsely documented workers work, they get paid cash. Its fairly prevalent in the desi owned businesses also.

    If someone, especially a muslim, presents a document to me (possibly forged), am I required to use systems like e-verify ( supposed to verify employment eligibility but supposedly has flaws), Should I just look at the doc, and if it looks good to me its good. Should one reject people because they are most likely to be illegal (mainly hispanics but could be desis also).

    There are worldly consequences if one is not complying (fines etc). Trying to figure out what is the sharia responsibility.

    What appears to me is, we should abide by country laws as far as they don't conflict with Shariah. This is a management law, which keeps the country and its people away from fasad. And Allah subhanahu wa ta'ala has forbidden creating fasad/ indiscipline. And this doesn't conflict with Shariah. Rather, not abiding this will encourage breaking management and discipline of a country, which is always not encouraged by Shariah.

    If you are required by law to verify these documentation for the eligibility of the employment, then you should definitely use those means. However, if it is not a requirement, rather a recommended practice to pass these documents through e-verify, then it is your discretion whether you wish to check further or not.

    Also since your govt does not allow illegal workers, and you have a doubt of the worker being illegal, the swift way would be to simply have the documentations verified. Islam forbids to put ourself in a position of being ridiculed and disrespected. By being negligent in these issues, you may put yourself and your company's repute as a muslim employer in shaky waters.
